Prenuptial Agreements Don’t Take The Love Out Of Marriage

Prenuptial and postnuptial agreements are much more common than they were even 10 years ago, in part because they no longer carry a stigma of “taking the romance out of marriage.” To the contrary, they are viewed as a practical means of avoiding conflicts over assets, income and financial obligations from a previous marriage and other situations.

The Waldrop Firm, P.C., in Germantown, creates effective and comprehensive prenuptial and postnuptial agreements that will stand up to legal scrutiny later if necessary. That last point is critical. A poorly structured prenuptial agreement can be rendered invalid and useless by a determined attorney. It is important to work with a lawyer who has experience drafting structurally solid prenuptial or postnuptial agreements.

We work with residents of Shelby County and throughout southwest Tennessee and North Mississippi on the full range of family law issues. Call 901-410-1118 to schedule a free consultation.

Who Needs A Prenuptial Agreement?

Prenuptial agreements are suitable for any marriage, but there are situations in which they are more common. These include:

  • When a party has children from a previous marriage and wants to ensure that inheritance is handled properly
  • When a party is bringing extensive assets into a marriage, such as real estate, inheritance, retirement accounts or privately owned businesses
  • When an individual owns a business and wants to keep the assets from that business separate from marital assets or protect a spouse from any business liabilities
  • When one or both parties are bringing substantial debt into a marriage

Timing is important when creating a prenuptial agreement. An agreement should be drafted well before the marriage in order to prevent any implications of pressure being applied to any individual to comply with the agreement. Both parties should have access to independent legal counsel for the development of a prenuptial or postnuptial agreement. We go as far as to recommend our clients offer to pay for their spouse’s lawyer. This helps to ensure that a prenuptial will stand up to any future challenge. We put it on record if a party declines the right to have an attorney at our client’s expense.
