Product liability law provides
compensation to persons injured by defective or dangerous products. If a product
is defective and causes an injury or death, the manufacturer can be sued for the
damages. The injured person can prove a product was defective in several ways:
it might have manufacturing defect, which caused it to fail, or it might be
defective because of poor or unsafe design. Some recent examples of defective
products include exploding fuel tanks, dalkon (shield) and air bag litigation
involving children. Damages which may be recovered include medical expenses,
lost wages, pain and suffering, loss of enjoyment of life, disfigurement and
permanent disability. An uninjured spouse can recover for the loss of services,
companionship and consortium.
