Once a Mississippi Court has determine
the custody and maintenance of the minor children under the age of 21, the Court
then applies the child support guidelines which are basic minimums.

A deviation from the child support
guidelines may be appropriate if application and guidelines would be unjust or
inappropriate in a particular case as determined according to the following
criteria:
1. extraordinary medical,
psychological, education or dental expenses;
2. independent income of child;
3. the payment of low child support and spousal support of the obligee;
4. for seasonal variation and both parents incomes or expenses;
5. the age of the child, taking into consideration the greater needs of older
children;
6. special needs that have traditionally been met within the family budget even
though the fulfilling of those needs were cause to support to exceed the
proposed guidelines;
7. the particular shared parental arrangements, such as where the non-custodial
parents spends a great deal of time with the children thereby reducing the
financial expenditures incurred by the custodial parent, or the refusal of the
non-custodial parent to exercise visitation, etc;
8. the total available assets of the obligee, obligor and child; and
9. any other adjustments which if needed to achieve and an equitable result
which made clear, for that be limited to, a reasonable and necessary existing
expense or debt.
Child support normally terminates upon
the emancipation of the child. The Court may determine that emancipation has
occurred and that no other support obligation exists with the child where the
child:
a. obtains the age of 21years old;
b. marriage;
c. discontinued full time enrollment in school and obtains full time employment
prior to obtaining the age of 21 years old; or
d. voluntarily moves from the home of the custodial parent and establishes
independent living arrangements and obtains full time employment prior to
turning 21 years old.
